1. Products and Appearance
Our units ship flat-packed as steel panels with hardware and are assembled on site. Units are available in the sizes, door configurations, and colors listed on our website at the time you order. We sell only the colors we stock: light gray, dark gray, and cream.
Steel is a manufactured product. Minor variations in color, finish, panel dimensions, and hardware between units, and between a unit and any photograph or sample, are normal and are not defects. Product specifications, photographs, and marketing descriptions are approximate and are not warranties.
2. Prices, Promotions, and Tax
Prices are those published on myyardvault.com at the time your order is accepted. Promotional pricing applies only to orders placed during the promotional period stated on the site.
All prices are for the unit only. Delivery, installation, site preparation, long-carry charges, and tax are separate and are itemized on your order.
New Mexico gross receipts tax is added to your order at the rate in effect for the delivery location, or for our location if you pick the unit up. If you claim an exemption, you must give us a valid nontaxable transaction certificate before we deliver.
We may correct pricing errors on our website, in a quote, or in an order confirmation. If the corrected price is higher than the price you were charged, you may cancel for a full refund instead of paying the difference.
3. Payment
Deposit. A deposit of 50% of the order total, including delivery, installation, site preparation, and tax, is due when you place your order.
Balance. The balance is due five (5) days before your scheduled delivery or installation date. If your delivery is scheduled less than seven (7) days after you order, the full amount is due at the time of order.
Pickup orders. Orders picked up at our yard are paid in full when you place the order.
Methods. We accept credit and debit cards and ACH bank transfers. Cash and check are accepted in person. A fee of $100 applies to any returned or reversed payment.
Late payment. If the balance is not paid when due, we may reschedule or cancel your order. A cancellation under this paragraph is treated as a cancellation by you under Section 4.
Financing. Any financing is provided by a third-party lender under a separate agreement between you and that lender. We are not the lender, and approval is not guaranteed.
4. Changes and Cancellation
You may change your order — size, color, door configuration, or scheduled date — at no charge until the unit is loaded for delivery, subject to availability and to any price difference.
If you cancel, the following applies. “Unit price” means the price of the unit itself, excluding delivery, installation, site preparation, and tax.

Card refunds. If you paid by card and our payment processor does not return its processing fee to us on a refund, we may retain that fee, up to 3% of the refunded amount.
If we cancel. If we cancel your order, or cannot deliver within the lead time stated in Section 8, you may cancel for a full refund with no deduction of any kind.
Sales made at your home or at an event. If we made this sale at your residence, workplace, or at a fair, show, or other temporary location, federal law gives you three business days to cancel for a full refund, and we will give you the written cancellation notice that law requires. Nothing in this section limits that right. This paragraph does not apply to orders you place online or at our showroom.
Refund timing. Refunds are issued to the original payment method within ten (10) days of cancellation.
5. Delivery
Delivery is priced by distance from the yard that stocks your unit, at the rates published on myyardvault.com. Additional charges apply for unpaved or rough access and for hand-carrying panels more than 50 feet or through a gate, as published on our Pricing page.
Before we deliver, you must make sure that:
- A truck and trailer can reach the drop point and turn around
- The route to the site is clear and at least 24 inches wide
- Someone 18 or older is present to accept delivery
- The area where the unit will sit is ready and accessible
- You have identified the exact placement location
Property damage. We are not responsible for damage to driveways, sidewalks, curbs, gates, fences, lawns, landscaping, irrigation, septic systems, or underground utilities along the route you direct us to use, or at the placement location you select. If our vehicle becomes stuck or disabled on your property or on a private road you direct us to use, you are responsible for recovery costs.
If we cannot deliver. If we arrive and the site is not accessible as you described, you may take delivery at the nearest accessible point at no additional charge, or we can reschedule for a redelivery fee equal to your original delivery fee.
Rescheduling. You may reschedule at no charge with at least 48 hours notice. With less notice, or if no one is present to accept delivery, a redelivery fee equal to your original delivery fee applies.
Risk of loss. Title and risk of loss pass to you when the unit is unloaded at your site, or when you or your carrier take possession at our yard.
Inspection. Inspect your unit on arrival. Note any shortage or visible damage on the delivery paperwork and tell us within 48 hours. Claims for shortage or visible damage made after 48 hours are waived.
6. Pickup
You may pick your unit up at our yard for the loading fee published on our website. You must bring a flatbed or trailer rated for the flat-packed weight of your unit, which runs about 100 pounds per foot of unit length, and your own straps or tie-downs. Our crew loads with a forklift.
Securing the load and transporting it safely and legally are your responsibility. We are not responsible for loss or damage after the unit leaves our yard, or for damage to your vehicle or trailer during loading.
Units are ready for pickup two to three days after your order. If your unit is not picked up within 14 days after we notify you that it is ready, storage of $25 per day applies.
7. Site Preparation and Installation
Site verification. Installation and site preparation prices assume a standard site. Before we schedule, you must send photographs of the placement location and the access route. We will confirm the site is suitable. If we determine it is not, you may cancel the installation for a full refund of the installation charge, or we can quote the additional work.
If we discover on arrival that the site materially differs from the photographs and information you gave us, and installation cannot proceed, we will place the unit at the nearest suitable location and refund the installation charge less a $150 trip charge. Site preparation charges, if the work was not performed, are refunded in full.
What installation includes. Installation means assembling the unit at the location you designate on ground that is ready to receive it. Installation does not include grading, excavation, concrete, retaining walls, tree or fence removal, utility locating or relocation, electrical or plumbing work, anchoring, or permits, unless you purchased that item separately.
Placement. You choose the placement location and are responsible for its suitability, including drainage, soil conditions, and clearance from structures and property lines. We are not responsible for settling, shifting, drainage problems, or damage arising from the location you select or from ground conditions.
Anchoring. We do not anchor units. Anchoring is not part of installation or site preparation, and no anchoring hardware is supplied. Wind can move an empty or lightly loaded unit. Deciding whether your unit should be anchored or ballasted, and arranging that work, is your responsibility.
Utilities. You must identify the location of private underground utilities, septic systems, irrigation lines, and similar improvements before we arrive. We are not responsible for damage to anything you have not identified.
8. Lead Times
Pickup orders are typically ready in two to three days. Delivery and installation are typically completed within 14 days of order, weather permitting. Office units are stocked in Gallup, and delivery to the Albuquerque area may take longer than 14 days.
We do not install in high wind, lightning, or other unsafe conditions, and we may reschedule for weather at no charge to you. Lead times are estimates except where Section 4 gives you a right to cancel.
9. Permits, Zoning, and Association Rules
You are responsible for determining whether your unit requires a building permit, complies with local zoning, setback, and placement rules, and complies with any homeowners association or covenant restrictions. You are responsible for obtaining any permit or approval required.
General information we publish about permit thresholds is a courtesy, not legal advice, and requirements vary by jurisdiction and change over time. We install where you direct us. We are not responsible for fines, removal or relocation costs, or other losses arising from placement that violates any code, ordinance, covenant, or association rule.
10. Warranty
Manufacturer warranty. Your unit carries the manufacturer’s warranty, two (2) years from the date of delivery, on the terms published by the manufacturer. We will help you present a warranty claim.
Not covered. Neither warranty covers normal wear, surface scratches, dents, rust from damage to the coating, damage from misuse, overloading, alteration, relocation by anyone other than us, accident, vandalism, or weather events including wind, hail, flood, and fire; condensation or moisture inside the unit; settling or shifting of the ground; or units assembled by anyone other than My Yard Vault.
Making a claim. Send us written notice with photographs within 30 days of discovering the problem, at
info@myyardvault.com or
(505) 382-6964, and give us a reasonable chance to inspect.
Except as stated in this section, we make no other warranty of any kind, express or implied. Any implied warranty, including any implied warranty of merchantability or fitness for a particular purpose, is limited in duration to the term of the written warranty that applies to your unit. Some states do not allow limits on how long an implied warranty lasts, so this limitation may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary by state.
11. Self-Assembly
If you assemble your unit yourself, you do so at your own risk. Follow the manual. Panels are heavy, have sharp edges, and can be caught by wind. Use the recommended number of people and appropriate equipment and protective gear. We are not responsible for injury, property damage, or damage to the unit resulting from assembly, disassembly, relocation, or modification performed by anyone other than My Yard Vault.
12. Limitation of Liability
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, loss of use, or damage to property stored in a unit. Our total liability arising out of any order is limited to the amount you paid us for that order.
Units are not fireproof, waterproof under all conditions, or a substitute for insurance. You are responsible for insuring the unit and its contents.
Nothing in these terms limits liability for personal injury or death caused by our negligence, or for any other liability that cannot be limited under New Mexico law.
13. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including weather, fire, flood, labor disputes, supplier or manufacturing delays, shipping and port delays, tariffs, vehicle breakdown, road closure, and acts of government.
14. Governing Law, Arbitration, and Disputes
These terms are governed by the laws of the State of New Mexico, without regard to conflict of laws principles.
In any arbitration or action to enforce these terms, the prevailing party is entitled to recover its reasonable attorney fees and costs.
Arbitration. Except as stated below, any dispute, claim, or controversy arising out of or relating to an order, a unit, a service, or these terms — whether based in contract, warranty, tort, statute, or any other theory — will be resolved by binding individual arbitration and not in court. This provision applies equally to you and to My Yard Vault, and is governed by the Federal Arbitration Act.
The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, in Albuquerque, New Mexico, or by telephone or video conference at your election. The arbitrator may award any relief a court could award to a party individually, including attorney fees where authorized by law. We will pay any AAA filing, administrative, and arbitrator fees that exceed what it would have cost you to file the same claim in state court. Judgment on the award may be entered by any court with jurisdiction.
What is not arbitrated. Either party may bring a qualifying individual claim in small claims court instead of arbitration. Either party may also ask a court for temporary injunctive relief to prevent immediate harm while arbitration is pending. These exceptions apply equally to both parties.
Class action waiver. Claims must be brought individually. Neither you nor My Yard Vault may bring or take part in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate claims or preside over any form of class proceeding. If this waiver is held unenforceable as to a particular claim, that claim — and only that claim — proceeds in court, and the rest of this section still applies to every other claim.
Right to opt out. You may opt out of arbitration by emailing
info@myyardvault.com within 30 days after you place your first order, stating your name, your order number, and that you decline arbitration. Opting out does not affect any other part of these terms and will not affect your order.
If this arbitration provision is held unenforceable in whole, any action arising out of or relating to an order or these terms must be brought in the state or federal courts located in Bernalillo County, New Mexico, and both parties consent to that jurisdiction and venue.
15. General
These terms, together with your order confirmation, are the entire agreement between us and replace any prior statement, quote, or representation. Sales staff have no authority to vary these terms. If any provision is unenforceable, the rest remains in effect. You may not assign your order without our written consent. We may revise these terms from time to time. Any revision applies only to orders placed after it is posted; the version in effect when your order is accepted governs that order. 16. Acceptance
Please read Section 14. It requires most disputes to be resolved by individual arbitration, waives class actions, and gives you 30 days to opt out.
Online orders. Checking the box marked “I have read and agree to the Terms of Sale, including the arbitration provision in Section 14” at checkout is your electronic signature and acceptance of these terms. We record the date and time of acceptance.
Orders placed by phone or in person. Signing your order confirmation, or paying your deposit, is acceptance of these terms.
